A partir do tema-problema – estaria a autonomia da vontade excluída da criação e da modelação dos direitos reais? –, defende-se, considerando a situação da doutrina, a hipótese da posse como direito real subversivo. Discute-se, pois, a taxatividade e a tipicidade dos direitos reais.
Abstract
From the problem-theme - would the autonomy of the will be excluded from the creation and modeling of real rights? - it is defended, considering the situation of the doctrine, the hypothesis of possession as a subversive real right. It discusses, therefore, the legal type and the typicity of the real rights.
