Vozes da enxovia: crime, castigo, clamor e resistência nas cadeias locais mineiras (1890-1914)

Abstract

Considering that only a small part of the detainees were properly prosecuted, tried, convicted and transferred to the large prisons, it is assumed that the study of local chains constitutes a microcosm of prison reality that possibly raged in different locations throughout the country . Based on this premise, the present research is devoted to studying part of the vast and little studied documentation related to the Police Chief of the Public Public Archive, more precisely the correspondence issued by the delegates of the cities of Sabará, Diamantina, Guanhães, Barbacena and Juiz de Fora (the latter chosen from the most relevant content presented by the analyzed sources) regarding the challenging conditions of the local chains as a counterpoint to the information present in the reports of the Police Headquarters located between 1890 and 1914. For this purpose, of the debates carried out by the leading Brazilian jurists on the reform of the prison system in Brazil based on the articulations of European Penitentiary Humanism. Faced with the difficulties in effecting the intended prison reform, it was sought to investigate the origins of this impasse from the historical limitations that obstructed the real implementation of political liberalism along the different social strata by analyzing the constitutional laws and Brazilian criminal laws in force between the negotiation of the independence of the country and the period pertaining to the First Republic. Finally, the scenario detailed so far has had its different nuances drawn through the study of the sources previously described.
