dc.description.abstractO problema de pesquisa do presente artigo consiste em duas questões: uma Inteligência Artificial (IA) pode ser considerada um autor? Quem é o proprietário do material protegido por direitos autorais produzido pela IA? O primeiro tópico faz uma breve abordagem dedutiva e teórica da ontologia da mente e da inteligência artificial. Posteriormente, a compatibilidade entre essas diretrizes para o conceito jurídico de autor contido em algumas Leis de Direitos Autorais. Ao final, propõe-se a impossibilidade ontológica de uma IA deter direitos de propriedade intelectual, ainda que derivados de atos autônomos, atribuindo-os ao seu programador/criador.

local.description.resumoThe research problem of the present article consists of two questions: can an Artificial Intelligence (IA) be considered an author? Who owns the copyrighted material produced by IA? The first topic gives a brief deductive and theoretical ap-proach to the ontology of mind and artificial intelligence. Subsequently, the compati-bility between these guidelines for the legal concept of author contained in some Copyright Laws. In the end, it is proposed the ontological impossibility of an AI holds intellectual property rights, even if derived from autonomous acts, attributing them to its programmer/creator.
