| dc.description.abstract | Despite treatment of the collective process is recent, historically, there have always been concerns that transcend the individual sphere. The genesis of the Brazilian collective process began with the popular action, provided constitutionally, for the first time in 1934. For the species of rights within the scope of the Brazilian collective process, it was found that there are three species, divided into two subgroups : transindividual rights (essentially collective rights) composed of diffuse rights and collective rights in the strict sense, and individual rights homogeneous (rights, 74, accidentally collective). The diffuse rights refer to unspecified groups of people, among which there is no defined legal relationship and the object of such rights is indivisible. Have collective rights in the strict sense, although they also indivisible object, stem from a basic legal relationship. Finally, in relation to individual rights homogeneous, the main characteristics of these rights are: the holders are determined or determinable, are essentially individual, the tutored object is indivisible, the injury to such rights is the individual, and originate from a source or common fact. | |

| local.description.resumo | Apesar de o tratamento do processo coletivo ser recente, historicamente, sempre existiram interesses que transcenderam a esfera individual. A gênese do processo coletivo brasileiro se iniciou com a ação popular, prevista constitucionalmente, pela primeira vez, em 1934.Em relação às espécies de direitos pertencentes ao âmbito do processo coletivo brasileiro, verificou-se a existência de três espécies, divididas em dois subgrupos: direitos transindividuais (direitos essencialmente coletivos) composto pelos direitos difusos e direitos coletivos em sentido estrito, e os direitos individuais homogêneos (direitos acidentalmente coletivos).Os direitos difusos se referem a grupos indeterminados de pessoas, entre as quais não existe um vínculo jurídico definido e o objeto de tais direitos é indivisível. Já os direitos coletivos em sentido estrito, apesar de terem também objeto indivisível, decorrem de uma relação jurídica básica. Por fim, em relação aos direitos individuais homogêneos, as características principais de tais direitos são: os seus titulares são determinados ou determináveis, são essencialmente individuais, o objeto tutelado é indivisível, a lesão a tais direitos ocorre a título individual, e se originam de uma origem ou fato comum. | |
