Resumo
Um exame da realidade histórica brasileira revela como a exceção se configura como a estrutura política originária, que não cessa de se atualizar e nos governar ‘secretamente’ e, devido ao fato de as estruturas políticas brasileiras terem o sistema escravagista como seu “repositório amargo”, temos que a gestão excepcional da vida é efetivada por meio de um viés racial. Essa captura da vida operada pela exceção, que, por meio de uma inclusão exclusiva, faz com que o direito figure como mera ‘vigência sem significado’, protege a ordem estabelecida contra o perigo de sublevações capazes de efetivamente ameaçá-la, aplainando-as e impondo-lhes um lugar que as restringe a formas jurídicas previamente codificadas – que, apesar de existirem, não se afastam do caráter meramente formal. Diante disso, esta tese pretende, por meio do método de montagem de imagens dialéticas benjaminiano, analisar como o aparato jurídico promove a limitação da política a instituições que refreiam a atuação de singularidades negras, capturando-as dentro de uma estrutura engessadora de possibilidades. E, devido à necessidade de pensar em linhas de fuga à exceção tornada regra, ela também se volta à rememoração da dimensão utópica da tradição política negra que visa transcender a organização social e as instituições político-jurídicas nas quais nos encontramos inseridos, ciente de que a luta pela liberdade é inconciliável com nosso modelo societal. Por fim, tendo em vista que o racismo é um problema branco e que insurreições ontológicas possuem uma dimensão contestatória que comumente nos escapa, procuro pensar modos de libertação de nós mesmos ou da prisão de nossa subjetividade branca que, quando não reconhecida e desafiada, presta-se à reiteração do racismo estrutural.
Abstract
An examination of the Brazilian historical reality reveals how the exception is configured as the original political structure, which never ceases to update itself and govern us ÔsecretlyÕ and, due to the fact that Brazilian political structures have the slavery system as their Òbitter repositoryÓ, the exceptional management of life is, therefore, carried out through a racial bias. This capture of life operated by the exception, which, through exclusive inclusion, makes the law appear as a mere Ômeaningless validityÕ, protects the established order against the danger of uprisings capable of effectively threatening it, flattening it and imposing on them a place that restricts them to previously codified legal forms Ð which, despite existing, do not deviate from the merely formal character. This doctoral thesis aims, through BenjaminÕs method of dialectical image montage, to analyze how the legal apparatus promotes the limitation of politics to institutions that curb the action of black singularities, capturing them within a plastering structure of possibilities. And, due to the need to think about lines of escape from the exception that has become the rule, it also turns to remembering the utopian dimension of the
black political tradition that aims to transcend the social organization and political-legal institutions in which we find ourselves inserted, aware that the fight for freedom is irreconcilable with our societal model. Finally, bearing in mind that racism is a white peoples
problem and that ontological insurrections have a contestatory dimension that commonly escapes us, I try to think about ways of liberating ourselves or the prison of our white subjectivity which, when not recognized and challenged, provides the reiteration of structural racism.
