Resumo
A presente pesquisa tem como escopo um estudo sistemático de como tem sido compreendido o Processo Coletivo na tutela dos direitos transindividuais e individuais homogêneos no Brasil, com o objetivo de se verificar sua efetividade à luz da Constituição de 1988. Primeiramente, busca-se fazer uma análise crítica quanto à realidade fática do tratamento dado a esse instituto no Brasil em face de sua construção legal, jurisprudencial e doutrinária. Em seguida, pretende-se abordar o que a Teoria do Reconhecimento de Hegel e a Hermenêutica Filosófica de Gadamer têm para contribuir para o Processo Coletivo. Em suma, objetiva-se demonstrar como que o Sistema Jurídico Brasileiro ainda utiliza timidamente essa importante ferramenta para a tutela de direitos de massa, para depois apontar perspectivas e soluções viáveis, baseadas na Teoria do Reconhecimento e na Hermenêutica Filosófica, capazes de ampliar a efetivação dos direitos transindividuais e individuais homogêneos, por meio da instrumentalidade do Processo Coletivo e o do acesso a uma ordem jurídica justa.
Abstract
The following research has as its subject matter a systematic study of how the collective suits has been understood in the protection of collective and transindividual rights in Brazil, in order to verify its effectiveness in light of the Constitution of 1988. First, we seek to make a critical analysis of the objective reality of the treatment given to this right in Brazil given its legal construction, jurisprudence and doctrine.Then, we intend to address what contributions Hegel's Theory of Recognition and Gadamer's Philosophical Hermeneutics may give to the Collective suits rights. In short, the objective is to demonstrate that the Brazilian Legal System still uses scarcely this important tool for the protection of collective rights, so therefore we are able to point to prospects and viable solutions, based on the Theory of Recognition and Philosophical Hermeneutics, which are capable of increasing the effectiveness of collective and transindividual rights through the instrumentality of the Collective suits and access to a just legal order.
