Resumo
Nos últimos anos, a justiça e a responsabilidade em situações de violação de direitos humanos e direito humanitário têm proporcionado importantes discussões, principalmente pelos diversos conflitos deflagrados atualmente. A preocupação é sobre a maneira não só de punir os responsáveis, mas, sobretudo, estabelecer mecanismos que garantam a jurisdicionalização internacional. Nesse sentido, propõe-se estudar o processo de construção dessa jurisdicionalização no Timor-Leste. Para tanto é necessário apontar os antecedentes históricos do conflito, as características e composição do Tribunal, com fins a demonstrar que os direitos humanos e humanitário passam a ser considerados fundamentais para a consolidação de qualquer sistema legal, bem como de um sistema de Direito Internacional Penal. A importância dos painéis especiais reside justamente no fato de ser um mecanismo apto a promover maior possibilidade de responsabilidade, resguardando ainda os direitos inerentes a este tipo de jurisdição. Além disso, tais painéis representam uma forma de solucionar os conflitos advindos das violações, preservando também a vontade e o domínio reservado dos Estados.
Abstract
In recent years, justice and responsibility in situations of violation of human rights and humanitarian law have provided important discussions, especially the various conflicts currently triggered. The concern is about the way not only to punish those responsible, but above all, to establish mechanisms to ensure the international jurisdictionalization. In this sense, it is proposed to study the process of building this jurisdictionalization in Timor-Leste. Therefore, it is necessary to point out the historical background of the conflict, the characteristics and composition of the Court, to demonstrate that human and humanitarian rights are now considered fundamental for the consolidation of any legal system, as well as an International criminal law. The importance of special panels lies precisely in the fact that a mechanism able to promote greater chance of responsibility, even protecting the rights in such jurisdiction. In addition, these panels are a way to resolve conflicts arising from the violations, and preserves the will and the reserved domain of States.
