O código florestal brasileiro de 1934: a legislação florestal nas disputas pelo território, um estudo de caso

| dc.description.abstract | It was only in 1934 that the Brazilian Forest Code was elaborated. However, most of its provisions were not applied. This issue is the object of the present paper, i.e., to understand the function of laws that would become “merely decorative”. The context of application of this legislation was addressed, that is, its effects on the control and dispute of the territory of the state of Paraná. The legislation was considered part of the modernization projects. Therefore, through an analysis of the pertinent legislation and the governmental reports on its application in the “wilderness” of Paraná, in the 1930 and 1950 decades, it is possible to understand the functions of the referred legislation, which, despite having fa iled to ensure t he preser vation of forests, wa s not merely a “misplaced idea”. | |

| local.description.resumo | Apenas em 1934 foi elaborado um Código Florestal federal no Brasil. Todavia as disposições de tal código, em grande parte, não foram aplicadas. Disto resulta a questão deste trabalho: entender a função de leis que se constituiriam “mera decoração na legislação”. O caminho seguido foi o de pensar seu contexto de aplicação, ou melhor, os seus efeitos no controle e configuração do território paranaense, e pensá-la como parte dos projetos de modernização. Assim, por meio da análise da legislação e de relatórios governamentais sobre a aplicação da legislação no “sertão paranaense”, nas décadas de 1930 a 1950, é possível compreender as funções de tal lei que, se não garantiram a manutenção da floresta, não eram apenas uma “ideia fora do lugar”. | |
