Resumo
O presente estudo busca demonstrar os entraves na comunicação entre a linguagem jurídica e os atores que acessam a justiça, dificultando assim a plenitude de um direito fundamental, implícito ou subtendido em uma justiça ao alcance de todos. A Constituição de 1988, deu ao cidadão o direito de acesso à justiça, reconhecido como um direito fundamental. E esse direito não se limita apenas a ter acesso à justiça, mas também de compreender os seus direitos perante ela. Assim, ter acesso a justiça vai além do ir e vir, engloba ainda, perceber o que a justiça pode fazer para aqueles que buscam a sua intervenção, através de uma linguagem que seja compreensível por todos. Desse modo, foi feita uma análise da linguagem jurídica a partir de sua origem no Direito Romano e os seus desdobramentos até os dias de hoje, através de suas formas rebuscadas e o juridiquês. Com isto, espera-se contribuir para os estudos já existentes, que buscam a inovação da linguagem jurídica, dando uma maior efetividade à sua função social. Partiu-se, principalmente, do levantamento bibliográfico de trabalhos já realizados, que serviram de base de estudo para análise do tema proposto, fornecendo dados atuais e de suma importância.
Abstract
The present study seeks to demonstrate the obstacles in the communication between the legal language and the actors who access justice, thus hindering the fullness of a fundamental right, implicit or subtended in a justice within the reach of all. The Constitution of 1988, gave the citizen the right of access to justice, recognized as a fundamental right. And that right is not only limited to having access to justice, but also to understanding your rights before it. Thus, having access to justice goes beyond the coming and going, it also encompasses realizing what justice can do for those who seek its intervention, through a language that is understandable by all. Thus, an analysis of the legal language was made from its origin in Roman Law and its developments to the present day, through its far-fetched forms and legalese. With this, it is expected to contribute to existing studies, which seek the innovation of legal language, giving greater effectiveness to its social function. It was mainly based on the bibliographic survey of works already carried out, which served as a study base for the analysis of the proposed theme, providing current and extremely important data.
