Resumo
O objetivo desta dissertação é apresentar as noções de família, direito e trabalho na literatura jurídica, teológica e econômica portuguesa no Antigo Regime, para, em seguida, tentar traçar um perfil das características e dos elementos da família como ordem normativa das relações laborais. O trabalho foi dividido em três capítulos. O primeiro será dedicado a questões metodológicas de História do Direito, que envolvem a discussão entre uma historiografia tradicional e uma historiografia crítica, refletindo sobre em que medida um ou outro projeto historiográfico interfere na compreensão da regulação das relações laborais no Antigo Regime. Em seguida, no segundo capítulo, serão apresentadas as principais características da família como ordem normativa situada em um contexto de pluralismo de ordens normativas, apresentando, inclusive, as possíveis latitudes e longitudes que poderia alcançar uma ordem familiar. Por fim, o terceiro capítulo tentará estabelecer os marcos normativos doutrinários, jurídicos, morais e econômicos, cunhados à administração doméstica, orientados à figura do paterfamilias no trato com os demais componentes domésticos em concepção extensa: mulher, filhos, criados e escravos.
Abstract
The dissertation aims to present notions about family, law and work, inside the legal, theological and economical literature from the Ancient Regime, in order to draft a profile with the elements and characteristics of family as a labor relations normative order. The research is divided into three chapters. The first will be devoted to methodological matters of Law History, involving the discussion between a traditional historiography and a critical one, in the desire of knowing in what measure they interfere in the comprehension of the Ancient Regime labor relations regulation. After this approach, in the second chapter, the main characteristics of a family will be presented as a normative order located in a context of pluralism of normative orders, showing even the possible latitudes and longitudes that a family order could achieve. Lastly, the third chapter will try to stablish doctrinaire, legal, moral and economical normative frameworks, used by the domestic administration, oriented to the paterfamilias figure, concerning the other domestic components in a wide comprehension: wife, children, servants and slaves.
