| dc.description.abstract | The paper presents a study on blockings against the effectiveness of the 1988 Economic Constitution. It begins with the analysis of the historical construction of our current constitutional order, and continues to identify mutilations and violations of the constitutionally adopted ideology caused by neo-liberal movements of regulation and austerity during the almost 30 years of the existence of the Brazilian Constitution of 1988. It is argued that effective understanding of the causes of the low effectiveness of the Brazilian Constitution must necessarily reflect on how the institutional blockings related to the Economic Constitution operate and reproduce. At the end, a research agenda orfor Economic Law is proposed based on the reflections produced. The study was based on bibliographical and documentary research, having as theoretical reference the work of the lawyer Washington Peluso Albino de Sousa, professor emeritus of the Faculty of Law of the UFMG and responsible for the pioneering introduction in Brazil of the discipline Economic Law in the undergraduate and postgraduate studies. | |

| local.description.resumo | O trabalho apresenta um estudo sobre bloqueios contra a efetividade da Constituição Econômica de 1988. Inicia com a análise da construção histórica de nossa ordem constitucional atual, e segue identificando mutilações e violações da ideologia constitucionalmente adotada causadas pelos movimentos neoliberais de regulação e de austeridade, durante os quase 30 anos da existência da Constituição Brasileira de 1988. Defende-se que efetiva compreensão sobre as causas da baixa efetividade da Constituição brasileira deve passar, necessariamente, sobre a reflexão de como operam e se reproduzem os bloqueios institucionais relacionados à Constituição Econômica. Ao final, é proposta uma agenda de pesquisa para o Direito Econômico a partir das reflexões produzidas. O estudo foi feito a partir de pesquisa bibliográfica e documental, tendo como referencial teórico a obra do jurista Washington Peluso Albino de Sousa, professor emérito da Faculdade de Direito da UFMG e responsável pela introdução pioneira no Brasil da disciplina Direito Econômico nos currículos de graduação e pós-graduação. | |
