| dc.description.abstract | This article aims to understand the insufficiency of the legal theories of sovereignty to understand the emergence of the modern State from the work of Michel Foucault. Thus, from a bibliographic analysis of the courses In defense of society, La société punitive, Security, territory and population and from the written Discipline and punish, it intend to exam, by an critic method, the foucaultian appreciation of the sovereign theories. For this, it is intended, first, to evidence the way in which an analytic of power must be made according to Foucault. Then, it will be treated as certain legal theories disregard the precautions of method that an analytic of power must follow and, therefore, the reason why they are not able to understand properly the modern emergence of the state. | |

| local.description.resumo | Este artigo tem por objetivo compreender a insuficiência das teorias jurídicas da soberania para entender a emergência do Estado moderno a partir de uma análise da obra de Michel Foucault. Assim, a partir de uma análise bibliográfica dos cursos “Em defesa da sociedade, La société punitive, Segurança, território e população” e do escrito “Vigiar” e punir, pretende-se, por um método crítico, examinar a apreciação foucaultiana às teorias da soberania. Para tanto, primeiramente, será evidenciado, mesmo que de forma esquemática, o modo como se deve ser feita uma analítica do poder segundo Foucault. Em seguida, será tratada como certas teorias jurídicas desconsideram as precauções de método que uma analítica do poder deve seguir e, por conseguinte, o motivo pelo qual não são capazes de compreender, de forma devida, a emergência moderna do Estado. | |
