Resumo
O objetivo deste trabalho foi utilizar ferramentas de mineração de dados do software R para recolher dados relativos à evolução da jurisprudência do Superior Tribunal de Justiça (STJ) sobre o dano ao erário, utilizando técnicas estatísticas de análise descritiva e visuais. Foram coletadas 1882 ementas proferidas pela Corte da data da sua instauração à data em que os dados foram recolhidos (7/4/1989 até 14/2/2021), que totalizaram 2997 páginas. Foi constatado que, até o julgamento do tema 897 a jurisprudência do STJ estava consolidada no sentido da imprescritibilidade do dano ao erário. Após esse marco, foram constatadas decisões pela prescritibilidade do dano, com prazo de cinco anos, variando o fundamento legal.
Abstract
With the computerization of the judiciary in recent decades, court decisions are available on the websites of the Courts. This is a very large amount of information that can be better analyzed through statistical resources, increasing the predictability of decisions. The objective of this work was to use data mining tools from the R software to collect data related to the evolution of the Superior Court of Justice (STJ) jurisprudence on the damage to the treasury, using statistical techniques of descriptive and visual analysis. A total of 1882 summaries were analyzed, covering the period from 1989 to 2021, totaling 2997 pages, and it was found that until the judgment on
the subject 897, the STJ jurisprudence was consolidated in the sense of the imprescriptibility of damage to the treasury. After this judgment, decisions were found recognizing the statute of limitations for the damage, with a period of five years, varying the legal basis.
