| Abstract: | O objetivo do presente estudo é analisar a concepção mais atual da jurisdição civil, concebida sob o prisma do Estado Constitucional, o modo de condução formal do processo que lhe é inerente, orientada à eficiência e à proporcionalidade, e, ainda, como as chamadas técnicas de gerenciamento processual contribuem para essa condução e, ao fim, em que medida estão previstas no ordenamento jurídico brasileiro. Para tanto, foram analisados os conceitos de jurisdição, duração razoável do processo, eficiência, cooperação e proporcionalidade. Empreendeu-se a análise do sistema inglês e suas técnicas de gerenciamento processual, bem como o papel das partes e do juiz na concretização dessas técnicas. Por fim, buscou-se demonstrar em que medida estão previstas técnicas de gerenciamento processual no Brasil e definir se o sistema processual civil brasileiro permite a adoção, no primeiro grau de jurisdição, de uma gestão processual orientada à eficiência e à utilidade do processo. |
| Abstract: | The aim of this study is to analyze the most updated conception of civil jurisdiction,conceived under the prism of the Constitutional State, the procedure inherent to it, oriented toefficiency and proportionality and how case management contribute to this conduct and, in theend, to what extent case management was introduced in Brazilian legal system. The conceptsof jurisdiction, reasonable duration of the process, efficiency, cooperation and proportionalitywere analyzed. An analysis of the English system and its case management techniques wasundertaken, as well as the analysis of the role of the parties and of the judge in implementingthese techniques. Lastly, it was sought to demonstrate the extent to which case management techniques are foreseen in Brazil and to define whether the Brazilian civil procedural system allows the adoption, in the first degree of jurisdiction, of a case management oriented to the efficiency and utility of the process. |
