| Abstract: | O presente texto pretende retomar a discussão da jurisdição constitucional como garantidora das condições processuais para o exercício da autonomia pública. Para alcançar este objetivo é preciso que o Supremo Tribunal Federal leve a sério o processo legislativo enquanto espaço institucionalizado da autonomia de cada cidadão. Assim, analisam-se casos concretos recentes em que, em tempos de crise, o Supremo Tribunal Federal deixou de atuar como garantidor do devido processo legislativo. |
| Abstract: | This paper intends to resume the discussion of the judicial review as guarantor of the procedural conditions for the exercise of public autonomy. To achieve this goal it is necessary that the Supreme Court takes seriously the legislative process as an institutionalized space of autonomy of every citizen. Thus, the article analyzes recent concrete cases in which, in times of crisis, the Supreme Court failed to act as the guarantor of due legislative process. |
