| Abstract: | O artigo procura trazer alguns apontamentos sobre o afastamento da Lei dos Crimes Ambientais do Direito Penal Democrático. Não tem a pretensão de exaurir o tema, mas, sim, provocar o leitor sobre algumas determinações da Lei n. 9.605/98 que não respeitariam princípios e institutos do Direito Penal Democrático. Realiza-se uma análise da sociedade atual, com suas características peculiares, assinalando-se a questão dos novos riscos. Dentre esses novos perigos do tempo hodierno, destaca-se a questão ambiental. Os problemas ambientais exigiram uma tutela legal do meio ambiente ecologicamente equilibrado, o que consubstanciou na edição da Lei dos Crimes Ambientais. Apesar da finalidade digna, percebe-se que a Lei n. 9.605/98, em alguns pontos, não observa cânones fundamentais do Direito Penal Democrático. |
| Abstract: | The article tries to bring some notes about the removal of the Law on Environmental Crimes Democratic Criminal Law. It does not pretend to exhaust the subject, but lead the reader on some provisions of Law n. 9.605/98, which would not respect the principles and institutions of the Democratic Criminal Law. It carried out an analysis of the current society, with its unique characteristics, pointing to the issue of new risks. Among these new dangers oftoday’s time there is the environmental issue. Environmental problems demanded legal protection of ecologically balanced environment which consolidated in the edition of the Environmental Crimes Law. Despite the worthy purpose, it is clear that the Law n. 9.605/98, at some points, does not observe fundamental canons of the Democratic Criminal Law. |
