Abstract: | A partir de exegese normativa e de revisão bibliográfica, o presente trabalho foi desenvolvido com o objetivo de caracterizar, a partir da evolução da legislação brasileira, a espécie de instituição financeira banco. Seja comercial, múltiplo, de câmbio, de investimento ou de desenvolvimento, o banco deverá observar limites mínimos de capital social e de patrimônio líquido, para ser constituído, e sempre vai exercer a atividade de intermediação financeira, ou seja, a coleta de moedas de clientes para negociá-las. Mas, as outras instituições financeiras, do mesmo modo, se submetem à observância daqueles limites para constituição, e também realizam a intermediação financeira. Assim, verificou-se como aspecto marcante do banco a sua submissão à extensa modulação regulatória que o autoriza a receber moeda oficial em contas de depósito e a partir daí, a negociá-la com terceiros, sem estar adstrito a um grupo específico de clientes, como no caso da cooperativa de crédito, ou a determinados fins sociais, como no caso da Caixa Econômica Federal. |
Abstract: | Based on the normative exegesis and a bibliographic review, this study was developed with the purpose of characterizing banks as a kind of financial institution from the evolution Brazilian Law. The bank, whether commercial, multiple, exchange, investment or development, must comply with minimum limits of capital stock and net worth to be constituted and carry out the activity of financial intermediation, that is, to collect money from one customer for negotiate it. But, the other financial institutions, too must comply with the same limits to be constituted and they also perform financial intermediation. Like this, the bank has a striking and verified aspect in its submission to the extensive regulatory modulation that authorizes it to receive official currency in deposit accounts and, from there, negotiate it with third parties without being bound to a specific group of customers, as in the case of credit cooperatives, or to certain social purposes, as in the case of the Federal Savings Institution. |
