| Abstract: | O presente artigo discutirá a conformidade da doutrina das dívidas odiosas segundo o Direito Internacional. Objetiva-se verificar a existência, no ordenamento jurídico internacional, de norma proibitiva da aplicação daquela teoria, bem como verificar a possibilidade de invocação a fim de afastar obrigações contraídas com credores internacionais. Para tanto, realizar-se-á uma análise dos argumentos trazidos a lume não só na jurisprudência de tribunais arbitrais internacionais e cortes domésticas, mas também nos principais posicionamentos teóricos a respeito. Verifica-se que os casos de não aplicação da doutrina decorrem de fatores de ordem político-econômica e não de uma objeção de natureza jurídica. Demonstra-se que não existe regra de Direito Internacional impeditiva da invocação da teoria e que a aplicação da doutrina é possível quando presentes os requisitos de caracterização da dívida odiosa. |
| Abstract: | The present article will discuss the accordance of the doctrine of the odious debts with international law. It aims to assess whether any rule of international law prohibits its application. It also intends to verify if the theory can be invoked as grounds for exemption of international obligations. In order to do so, this work will analyze the arguments brought before international arbitral tribunals, domestic courts and scholarly writings dealing with the issue. It is verified that the cases of non-application of the doctrine resulted from political and economic factors rather than from a legal objection. Thus it is demonstrated that there is no rule of international law prohibiting its the invocation. Conclusively, it is stated that the application of the doctrine is possible when the requirements for characterization are met. |
