| Abstract: | Este artigo discute decisão do Tribunal de Justiça do Rio Grande do Sul (TJRS) que, mesmo diante da tendência a decisões judiciais que declaram a inconstitucionalidade da lei municipal que aprova o Plano Diretor sem prévia audiência pública, acatou a constitucionalidade quando se tratava de município que não está obrigado a elaborar o respectivo Plano Diretor. Diante do processo acelerado e desorganizado de urbanização brasileiro, o planejamento estratégico de organização das cidades é fundamental para a garantia do bem-estar dos munícipes. Nesse contexto, é indiscutível a relevância da participação social no procedimento de elaboração e revisão dos Planos Diretores, a qual, além de promover uma gestão democrática das cidades, contribui para organizá-las. O método empregado na pesquisa é o Estudo de Caso com suporte em consulta bibliográfica. |
| Abstract: | This paper discusses the decision of the Court of Rio Grande do Sul (TJRS) that, despite the trend of judicial decisions declaring the unconstitutionality of municipal law approving the master plan without prior public hearing, upheld the constitutionality when the municipalty is not required to prepare its master plan. In the face of accelerated and disorganized process of brazilian urbanization, the strategic planning organization of cities is critical to guarantee the welfare of the citizens. In this context, it is undeniable the importance of social participation in the procedure for establishing and reviewing master plans, which, in addition to promoting a democratic management of cities, helps to organize them. The method used in the research is the case study, supported in bibliographic research. |
