| Abstract: | Os processos integrativos que fomentaram o surgimento da atual União Europeia assentaram no espaço europeu uma ordem jurídica autônoma. Além da autonomia consolidada em face das jurisdições nacionais, entende-se, desde os idos de 1960, que os preceitos do direito comunitário primam sobre a ordem jurídica dos Estados-membros, inclusive sob a ótica constitucional. Nesta senda, o presente artigo discute as numerosas indagações ensejadas pelo princípio da primazia, bem como as discussões suscitadas ante os tribunais nacionais e do próprio Tribunal de Justiça da União Europeia acerca da pertinência e da extensão do referido princípio. |
| Abstract: | The integration processes which fomented the emergence of the European Union have established an autonomous legal order in the European area. In addition to its consolidated independence of national jurisdictions, it has been understood since the 1960s that the precepts of Community Law override the legal order of the Member States, even under a constitutional angle. In this context, this article reviews the unnumbered questions raised by the principle of primacy, as well as the national and the Union European Court’s statements about that tenet’s suitability and scope. |
