Abstract: | O Direito à diversidade é um dos fundamentos do novo constitucionalismo democrático, não se confundindo com o direito que ser origina no constitucionalismo liberal de igualdade perante a lei ou o direito à diferença, incorporado às Constituições sociais e democrática no final do século passado. O artigo analisa como o novo constitucionalismo, expresso nas Constituições democráticas do Equador (2008) e Bolívia (2009) pode representar uma ruptura com a modernidade colonial europeia. |
Abstract: | The right to diversity is one of the foundations of the new democratic constitutionalism, not to be confused with the right originated in the liberal constitutionalism of equality before the law or the right to difference, incorporated into the social and democratic Constitutions at the end of the last century. The article analyzes how the new constitutionalism, expressed in the democratic Constitutions of Ecuador (2008) and Bolivia (2009), can represent a rupture with European colonial modernity. |
