| Abstract: | O presente artigo pretende evidenciar que o fenômeno da crise da legalidade alcançou a seara consumerista, tendo em vista que a legislação existente não tem sido cumprida pelos fornecedores, violando os direitos dos consumidores. Tendo sido feita a análise de dados estatísticos do PROCON (Órgão de Proteção e Defesa do Consumidor), de Belo Horizonte, no período de 2014 a 2016, verificou-se que houve aumento do número de consumidores que o procura para exigir o cumprimento dos seus direitos. A pesquisa utilizou-se do método jurídico dedutivo e efetuou levantamento de dados por meio de pesquisa bibliográfica e estatística. Concluiu-se que a crise da legalidade na seara consumerista relaciona-se à inflação legislativa, à dificuldade de acompanhar a complexidade e velocidade das mudanças sociais, o descrédito da lei por não representar a vontade da sociedade e por não conseguir fornecer respostas satisfatórias para as demandas existentes e ao processo de deslegalização. |
| Abstract: | The present paper intends to stress the crisis of legality in the consumer sector, considering that the laws, although they exists, are not being fulfilled by the suppliers. There is an increase in the number of consumers seeking the Consumer Protection and Protection Agency (PROCON), in Belo Horizonte City, to demand the fulfillment of their rights. This reality will be demonstrated from the statistical data of PROCON-BH from 2014 to 2016. The deductive legal method was use in addition to the bibliographic and statistical research. It was concluded that the crisis of legality in the Consumer Law may be related to: legislative inflation, the difficulty of following the complexity and speed of social changes, the discrediting of the law for not representing the will of society and for not being able to provide satisfactory answers to existing demands, and to the process of delegitimation. |
