Abstract: | O trabalho analisa os impactos da tecnologia da informação na produção normativa. Utilizando a Legisprudência como marco teórico e considerando principalmente o dever de justificação imposto ao legislador, o trabalho analisa como a tecnologia da informação pode impactar a produção normativa. No que tange à tecnologia da informação, são analisadas especificamente as potencialidades de automação de procedimentos e extração de informações de processos judiciais utilizando-se inteligência artificial, especificamente a NLP (processamento de linguagem natural). São analisadas características da plataforma PJe (Processo Judicial eletrônico) e suas vantagens e desvantagens para extração de informações por meio da aplicação de técnicas de inteligência artificial. Estabelecendo-se que a tecnologia disponível possibilita acesso a tais informações, como índices de litigiosidade, frequência de invocação de determinada legislação em processos judiciais, alegações de omissão legislativa ou pedidos de declaração de inconstitucionalidade, discute-se se a busca por tais informações seria um dever do legislador. Ademais, e atentando-se à teoria do diálogo das fontes do direito, analisa-se quais podem ser os impactos da demonstração de informações dessa natureza para a legitimidade de normas vigentes, especialmente considerando que, diferentemente do judiciário, o dever de justificação do legislador contempla não apenas o dever de justificar o rompimento com o direito posto, mas também o dever de justificar a manutenção do direito vigente. |
Abstract: | The work analyzes the impacts of communication and information technology on law-making. Using Legisprudence as a theoretical framework and considering mainly the duty of justification imposed on the legislator, the paper analyzes how information technology can impact normative production. With regard to communication and information technology, the potential for automating procedures and extracting information from lawsuits using artificial intelligence, specifically NLP (Natural Language Processing) are specifically analyzed. Characteristics of the PJe platform (electronic court proceedings) and its advantages and disadvantages for extracting information through the application of artificial intelligence techniques are analyzed. Establishing that the available technology allows access to such information, such as litigation rates, frequency of invocation of certain legislation in legal proceedings, allegations of legislative omission or requests for a declaration of unconstitutionality, it is discussed whether the search for such information would be a duty of the legislator. Furthermore, and paying attention to the theory of dialogue of the sources of law, it is analyzed what the impacts of the demonstration of information of this nature may be for the legitimacy of current norms, especially considering that, unlike the judiciary, the legislator's duty to justification encompasses not only the duty to justify the overturn of a precedent, but also the duty to justify the maintenance of the current law. |
