Irregulável mundo novo: a regulação de big techs na infosfera

Abstract

This research investigates the possibility of regulating great digital platforms, primarily those we call Big Techs, from the precepts of Legistics and Philosophy of Information. Thus, mainly through exploratory bibliographic research, we present some concepts that are relevant to the reflection we propose, such as digital platforms, platformization, surveillance capitalism, infosphere, quality of law and problematization of legislative impulse. The starting point of this research is that the first step towards the construction of any adequate legislation or regulation, endowed with efficacy and effectiveness, is the factual understanding of the problem to be solved, so that one can envision alternatives for action and select which alternative is best in line with the intended results, minimizing side effects. We do this considering the information revolution whose pace and direction have been dictated by the Big Techs, and which has among its consequences the radical transformation of what human beings think of themselves and of the world around them. As we relate all the previously explored concepts, we conclude that it is possible to regulate digital platforms according to the method of Legistics, but that regulation must be constructed in a way in which the course and time of human experience in the infosphere are guided by humans beings themselves, not by the Big Techs, in a resumption of a technological and citizen-based sovereignty that is not only against the commodification of human behavior, but also against the imposition of a concept of human freedom that do not come from human beings themselves.
