| Abstract: | Investiga-se no presente trabalho a possibilidade de se afirmar que a realização do controle pedagógico é uma das funções atribuídas aos Tribunais de Contas brasileiros, ainda que não haja previsão expressa nesse sentido no rol de competências do art. 71 da Constituição Federal. Para isso analisa-se o arcabouço jurídico-constitucional existente no ordenamento jurídico brasileiro e conclui-se que ele não só sustenta a afirmação de que o controle pedagógico é uma das funções possíveis de serem exercidas pelas Cortes de Contas, como incentiva sua realização, por se tratar de mecanismo de controle dialético e consensual que garante o aperfeiçoamento da gestão pública, de forma consentânea com os traços característicos da Administração Pública Contemporânea. |
| Abstract: | The present work investigates the possibility of affirming that the accomplishment of the pedagogical control is one of the functions attributed to the Brazilian Courts of Auditors, although there is no express provision in this sense in the list of competences of art. 71 of the Federal Constitution. Thereby, the existing legal-constitutional framework in the Brazilian legal system is analyzed and it is concluded that it not only supports the statement that pedagogical control is one of the possible functions to be exercised by the Courts of Auditors, but also encourages its realization, because it is a dialectical and consensual control mechanism, which guarantees the improvement of public management in a manner consistent with the characteristic features of Contemporary Public Administration. |
