Abstract: | This dissertation seeks to answer the question of whether the existing international legal regime on the international responsibility of States can effectively address breaches committed in the context of Autonomous Weapons Systems (AWS). To the extent that it cannot do so, it endeavors to map out the main gaps and some possible approaches to address them. Part I sets the ground for the present research to guide this analysis. First, it provides a concept of AWS considering a degree of unpredictability as one of its inherent features. Next, it discusses the accountability gap AWS generate and how the international community has put far more emphasis on individual responsibility rather than State responsibility. Part II analyzes the challenges AWS pose to the regime governing State responsibility under international law, as codified in the Draft Articles on State Responsibility (ARSIWA). In this regard, it discusses attribution, breach of an international obligation, tempus comissi delicti, multiple States involved in a breach, force majeure, assurance of non-repetition, issues related to damage, the human-machine interaction and its impacts on State´s responsibility, responsibility for not using AWS, weapons review and the duty of due diligence. Part III summarizes the challenges discussed in part II in thirteen issues of concern and presents possible paths de lege ferenda to address each of those issues, mainly a paradigm shift in attribution and strict liability, among seven other more specific proposals. The conclusion reached is that the current regime on the international responsibility of States is insufficient to deal with the new challenges AWS pose. De lege ferenda, the dissertation argues for following the paths suggested in part III. It also reflects on parts II and III's findings and how many of AWS's challenges to State´s responsibility apply to other autonomous devices. Therefore, through the case study of AWS, this dissertation also opens the broader discussion of the gaps in the international responsibility of States regarding autonomous device misdoings. |
Abstract: | Esta tese procura responder à pergunta de se o regime jurídico internacional existente sobre a responsabilidade internacional dos Estados é capaz de endereçar as violações cometidas no contexto de Sistemas de Armas Autônomas (AWS). Em caso negativo, visa mapear as principais lacunas bem como sugerir abordagens possíveis para solucioná-las. Para guiar essa análise, a Parte I estabelece as bases para a presente pesquisa. Primeiro, apresenta um conceito de AWS e aborda um certo grau de imprevisibilidade como uma de suas características intrínsecas. Em seguida, discute-se a lacuna de responsabilidade gerada pelos AWS, e a maior ênfase da comunidade internacional na responsabilidade individual em detrimento da responsabilidade dos Estados. A Parte II analisa os novos desafios que os AWS representam para a responsabilidade internacional dos Estados, conforme previsto no Projetos de artigos sobre responsabilidade internacional dos Estados. Neste âmbito discute a atribuição, a violação de uma obrigação internacional, tempus comissi delicti, diversos Estados envolvidos em uma violação, força maior, garantia de não repetição, questões relacionadas a danos, a relação homem-máquina e os seus impactos na responsabilidade dos Estados, omissão por não usar AWS, revisão de armas e obrigação de diligência dos Estados. A Parte III resume os desafios apresentados na Parte II em treze pontos problemáticos e discute possibilidades de lege ferenda para endereçar tais pontos, principalmente uma mudança de paradigma na atribuição de responsabilidade e responsabilidade objetiva, entre outras sete propostas específicas. A conclusão alcançada é que o atual regime de responsabilidade internacional dos Estados é insuficiente para lidar com os desafios que AWS apresentam. De lege ferenda, defende-se as alternativas sugeridas na Parte III. Também se reflete sobre as conclusões das partes II e III e como muitos dos desafios dos AWS à responsabilidade do Estado também são aplicáveis a outros dispositivos autônomos. Assim, por meio do estudo de caso das AWS, esta tese também abre a discussão mais ampla quanto às lacunas da responsabilidade internacional do Estado quanto a violações cometidas por dispositivos autônomos em geral. |
