| Abstract: | Este artigo tem por objetivos abordar a polissemia dentro da Análise do Discurso e o fenômeno da ponderação dentro da Teoria Discursiva do Direito de forma interdisciplinar (Linguística e Direito). O estudo bibliográfico também apresenta uma análise da fala de um parlamentar brasileiro em uma rede social sob o viés do discurso de ódio e da liberdade de expressão. Orlandi (2001;2007), Schons (2000), Fiorin (2001) serão os norteadores da análise dentro da Linguística e na área do Direito Robert Alexy (2014) contribuirá com a reflexão acerca da liberdade de expressão e do discurso de ódio e as acepções jurídicas do feito na Carta Magna e na Convenção Interamericana contra toda forma de discriminação e intolerância. Com este trabalho busca-se refletir sobre o discurso-na-ação, analisando os desdobramentos jurídicos das ações do parlamentar. |
| Abstract: | This article has the following goals to achieve: the polysemy inside the Discourse Analysis and the phenomenon of the weighing inside the Discourse Theory in an interdisciplinary way (Linguistics and Law). The bibliographic study presents analysis of a Brazilian politician’s speech in a social network under the bias of hate speech and freedom expression. Orlandi (2001;2007), Schons (2000), Fiorin (2001) are the guides of this analysis inside the Linguistics and in the Law area Robert Alexy (2014) will contribute the legal meanings the act in the Magna Carta and in the Inter-American Convention against all forms of discrimination and intolerance. This work seeks to reflect on discourse-in-action, analyzing the legal consequences of the politician's actions. |
