| Resumen: | O objetivo do artigo é problematizar a atuação de cortes em contextos de erosão democrática aprofundados por novas tecnologias. Sob a abordagem metodológica de estudo de caso, o artigo analisa a decisão do Tribunal Superior Eleitoral nas ações de investigação judicial eleitoral da chapa Bolsonaro/Mourão envolvendo o disparo em massa de mensagens por meio do WhatsApp nas eleições presidenciais de 2018. Utiliza como referencial teórico tanto o conceito normativo de constitucionalismo digital quanto modalidades decisionais adotadas por tribunais em temas de alto impacto político nos sistemas jurídicos comparados. Conclui-se que, apesar dos sinais relevantes de uma decisão expansiva na fundamentação, porém restrita em seu dispositivo, o tribunal adotou uma posição arriscada e que confunde suas diversas funções no sistema constitucional brasileiro, não atentando para o cenário de forte deterioração institucional. |
| Abstract: | The article’s objective is to question the role of courts in contexts of democratic erosion deepened by new technologies. Using the case study methodology, the article analyses the Brazilian Electoral Superior Court ruling on the judicial electoral investigation procedures of the slate Bolsonaro/Mourão, involving the mass messaging through WhatsApp in the presidential elections of 2018. It uses as a theoretical reference the normative concept of digital constitutionalism and the types of remedies adopted by tribunals in themes of high political impact within comparative legal systems. The conclusion is that, notwithstanding the relevant features of a decision that is expansive in its reasoning, but restricted in its holding, the tribunal adopted a risky position that also bewilder its diverse functions in the Brazilian constitutional system, not paying attention to the scenario of strong institutional deterioration. |
