Abstract: | A “superação do voluntarismo” é o enunciado que sintetiza uma narrativa histórica muito presente no discurso do direito civil brasileiro atual. São tidas como voluntaristas as teorias e doutrinas jurídicas que conferem centralidade ao conceito de vontade na definição de categorias tais como o contrato e o negócio jurídico. Conta-se que o voluntarismo fora uma concepção jurídica de matriz liberal e individualista, formulada no século XIX e que, ao longo do século XX, em função de transformações históricas, políticas e econômicas, teria sido “superado”. De outra parte, dizê-lo superado é supor que em algum momento de nosso passado teórico discursivo, esse dito voluntarismo tenha sido refutado. Nossa investigação se volta, sobretudo, ao desvendamento desta suposta refutação, para o que nos valemos do marco teórico baseado naquilo que António Manuel Hespanha retratou como uma história das categorias jurídicas, e também na Arqueologia do saber de Michel Foucault. A abordagem se inicia por uma análise dos discursos da civilística brasileira atual, de que se extraem alguns resultados. Em primeiro lugar, é possível constatar como os imaginários da história do direito civil têm sido decisivos na determinação de sua agenda teórica na atualidade. Em segundo lugar, essa primeira parte da investigação aponta, indelevelmente, para a obra do civilista italiano Emilio Betti, particularmente sua Teoria generale del negozio giuridico, como aquela que deveria conter uma refutação do voluntarismo. Abrindo-se, então, a segunda parte da investigação, e partindo para a busca da refutação do voluntarismo que supúnhamos poder encontra em Betti, nos deparamos, curiosamente, com uma nova narrativa histórica, articulada como argumento teórico. No caso, uma disputa do imaginário histórico do direito romano. Nessa disputa, as posições assumidas por Betti não partiam de disposições puramente jurídicas ou teóricas. Mas eram orientadas por circunstâncias históricas e ideológicas postas em seu tempo e lugar, em que estava em voga o fascismo. Neste contexto Betti tomou claramente um partido, e, segundo iremos sustentar, sua teoria do negócio jurídico esboçava sua própria contribuição na mobilização de reformas políticas, administrativas e jurídicas voltadas à consolidação do Estado totalitário. |
Abstract: | The “voluntarism overcome” is the enunciate that synthesizes a historical narrative very common in the Brazilian Civil Law discourse in our days. Its considered voluntaristic any juridical theory or doctrine that assert some centrality to the concept of will in the definition of juridical categories like contract or juridical act (“negócio jurídico”). They say that voluntarism have been a juridical conception with liberal and individualistic basis, elaborated on the 19th century, and that, belong 20th century, because of historical, political e economic transformations, it would’ve been “overcame”. In the other hand, saying that it is overcame, is supposing that, in some point of our theoretical discursive past, this so called voluntarism have been refuted. Our investigation seeks to enlighten this supposed refutation. For that, our theoretical framework is based on Antonio Manuel Hespanha’s History of juridical category, and we are based also the Michel Foucault’s L’archeólogie du savoir. The approach begins by analyzing the current Brazilian civilistic discourses, of which we can extract some results. In the first place, it possible to ascertain that the Civil Law History imagination have being decisive on determining its theoretical agenda these days. In the second place, the first part of the investigation points clearly to the Italian civilist Emilio Betti’s work, particularly his Teoria generale del negozio giuridico, as the one that should contain the expected voluntarism refutation. Now, opening the second part of the approach, and seeking the refutation of voluntarism where it’s supposed to be, we curiously come across to another historical narrative, articulated as a theoretical argument. In that case, a dispute on the historical imagination of Roman Law. In that dispute, the position taken from Betti is not based on purely juridical and theoretical dispositions. But it was guided by historical circumstances of his time and place, in which fascism was in vogue. In that context, Betti took clearly a side, and, was we will argue, his theory of judicial act would sketch his own contribution to the mobilization for the political, juridical and administrative reforms focused on the totalitarian State consolidation. |
