Abstract: | Esta pesquisa analisa a tradição teórico-política do marxismo negro desde as lentes da crítica marxista do direito tomada pelo marxismo revolucionário. Caracterizamos o assim chamado marxismo negro como sendo o particular contributo da intelectualidade negra revolucionária que encontra no marxismo a ferramenta necessária para análise das diferentes formas sociais do racismo e colonialismo e ação política estratégica da luta social. Apresentamos a tensão existente na teoria marxista do direito entre crítica da forma jurídica e imperativo da luta de classes como uma discordância dos tempos da crítica e da estratégia. Propomos a noção de contratempo da política e práxis para mobilizar sínteses, defendendo que a crítica marxista da razão jurídica é ao mesmo tempo análise materialista da natureza relacional do direito e teoria social dos seus usos políticos pelo agir estratégico. A partir da análise jurídico-política de diferentes quadros sócio-históricos do marxismo negro defendemos que a práxis negra revolucionária combina análise materialista da relação entre direito e racismo, crítica estrutural da forma jurídica e formulação política de usos tático-pedagógicos do direito para a ação estratégica do antirracismo revolucionário. |
Abstract: | This research analyzes the theoretical-political tradition of Black Marxism through the lens of Marxist criticism of law taken by revolutionary Marxism. We characterize so-called Black Marxism as the contribution of revolutionary black intellectuals who find in Marxism the necessary tool for analyzing the different social forms of racism and colonialism and for the strategic political action of social struggle. We present the tension within Marxist legal theory between the critique of the legal form and the imperative of class struggle as a disagreement of the times of critique and strategy. We propose the notion of political broken-time and praxis to mobilize syntheses, arguing that the Marxist critique of legal reason is at once a materialist analysis of the relational nature of law and a social theory of its political uses by strategic action. From the legal-political analysis of different socio-historical frameworks of Black Marxism, we argue that revolutionary Black praxis combines a materialist analysis of the relationship between law and racism, a structural critique of the legal form, and the political formulation of tactical-pedagogical uses of law for the strategic action of revolutionary anti-racism. |
