| Abstract: | Pelo presente trabalho quis-se estudar o Direito à Convivência Familiar de crianças e de adolescentes no direito brasileiro, buscando tratá-lo de forma sistemática e visando dar-lhe coerência e consistência teórica. Ao delimitar o atual paradigma do Direito da Criança e do Adolescente, fez-se necessário traçar o desenvolvimento dos direitos infanto-juvenis com o objetivo de explicitar as diferenças, ainda hoje, existentes entre a legislação e a prática no país, além de examinar os princípios basilares do Direito Internacional da Criança. Trabalhou-se a noção jurídica contemporânea de família no direito pátrio, o papel da criança e do adolescente em tais entidades e a convivência familiar para, então, conceituar o Direito à Convivência Familiar, destacando todas as suas facetas. Partindo da definição construída, analisou-se a estrutura valorativa normativa desse direito, extraindo seus princípios específicos. Por fim, identificaram-se os instrumentos existentes no direito nacional para efetivação do Direito à Convivência Familiar de crianças e de adolescentes, questionando-os e procurando adaptá-los a essa nova função. |
| Abstract: | The present work aimed to study the Right to a Family of children and adolescents in Brazilian law, seeking to treat it systematically and to give it more coherence and theoretical consistency. In order to delimitate the current Rights of Children and Adolescents paradigm, it was necessary to trace the development of youth and children's rights, aiming to clarify the still existing differences between law and practice in the country, in addition to examining the basic principles of the International Children Law. We worked with the contemporary legal notion of family in parental rights, the role of children and adolescents in such entities, and family life, then conceptualizing the Right to Family, highlighting all its aspects. Starting from the definition built, we analyzed this right's evaluative and normative framework, extracting its specific principles. Finally, we identified the instruments in the national law that can be used to enforce the Right to a Family of children and adolescents, questioning them and trying to adapt them to this new role. |
