dc.description.abstract | The liberal doctrine is congenitally refractory to utopianism. For this reason, the western left as proved reticent when the subject is to idealize models of social organization differents from that established by speculative capitalism. However, criticism and utopia represent complementary strengths. Few fields of the humanities are so loaded with anti-utopianism as the legal knowledge. Thus, in order to construct a critical legal thinking, we need to correlate utopianism and Philosophy of Law. In an effort to criticize the prevailing legal order, the vast collection of utopian novel compounds in the West since the sixteenth century can serve as a source of inspiration, emphasizing - against the pensée unique, the naturalization of the status quo - the possibility of alternatives. We are especially interested in delineating a dialogue between the Critical Legal Studies (north american movement that emerged in the 1970s) and the utopian literature. We will specifically investigate the utopias of the sixteenth century, because we believe that returning to the time of emergence of the genre we will be able to prove the indispensability of the link between criticism of society and utopian representation. | pt_BR |
dc.description.resumo | A doutrina liberal é congenitamente refratária ao utopismo. Por essa razão, a esquerda ocidental vem se mostrando reticente, quando se trata de idealizar modelos de organização social diversos do estabelecido pelo capitalismo financeiro. Porém, crítica e utopia representam forças complementares. Poucos campos das Humanidades são tão carregados de antiutopismo quanto o saber jurídico. Assim, na construção de um pensamento jurídico crítico, que questione a sociedade de mercado, precisamos correlacionar utopismo e Filosofia do Direito. No esforço para criticar a ordem legal imperante, o vasto acervo de romances utópicos compostos no Ocidente desde o século XVI pode servir como fonte de inspiração, enfatizando contra o pensamento único, a naturalização do status quo a possibilidade de alternativas. Estamos interessados, especialmente, em delinear uma interlocução entre os Critical Legal Studies (movimento norte-americano surgido na década de 1970) e a literatura utópica. Trataremos, especificamente, das utopias do século XVI, pois acreditamos que, retornando à época de surgimento do gênero, seremos capazes de comprovar a imprescindibilidade do vínculo entre crítica da sociedade e representação utópica. | pt_BR |
