| Abstract: | O sujeito de direito é uma categoria abstrata erigida no paradigma da modernidade, que congrega valores universais como a igualdade, a liberdade e a racionalidade. Contudo, ao longo da história, tais acepções serviram como referenciais da experiência do masculino por excelência, ocultando a lógica patriarcal presente, por exemplo, nas diversas violências de gênero contra as mulheres. Enquanto sujeitas revolucionárias do feminismo, movimento fundamentalmente político em sua origem, foi tensionado o discurso de pretensa universalidade do sujeito jurídico por não as alcançar, diante da manutenção da dominação patriarcal. Porém, ao mesmo passo, o próprio feminismo também se encontra no dilema em buscar, através das instituições jurídicas, o reconhecimento das mulheres enquanto sujeitas. |
| Abstract: | The subject of law is an abstract category erected in the paradigm of modernity, which brings universal values as equality, freedom and rationality. Throughout history, however, such meanings served as reference points for male experience, hiding the patriarchal logic present in the various gender violence against women. As a revolutionary subject of feminism, a fundamentally political movement in its origin, the discourse of the pretended universality of the juridical subject was strained for not reaching them, in the face of the maintenance of patriarchal domination. At the same time, however, feminism itself is also in the dilemma of seeking, through legal institutions, the recognition of women as subjects. |
