| Abstract: | O presente trabalho tem por objeto a relação entre Direito, Política ePoder, e como objetivo demonstrar que, mais do que uma simples relação, eles são faces de uma mesma realidade. Primeiramente é feito apanhado das noções de Direito, Política e Poder. A seguir é feito uma análise crítica de algumas idéias enraizadas na cultura jurídica dominante com o objetivo de desmistificar uma visão tradicionalista do Direito como algo apartado do jogo político e da disputa por poder. Em seguida, é feito um histórico de fenômenos que demonstram esta indissolúvel relação, com destaque para o ativismo judicial. Por fim, procura-se demonstrar que o Direito é instrumento de ação política, independente da pretensão de neutralidade ou do espectro ideológicoque se adote, clamando para que a classe jurídica se conscientize deste papel. |
| Abstract: | The present work has for object the relation between Law, Politics andPower, and as a goal to demonstrate that, more than a simple relation, they are just aspects of the same reality. First it is made a briefing on the notions of Law, Politics and Power. Then follows a critical analysis of some ideas very well disseminated and accepted in the dominant legal culture with the objective to demystify a traditionalistic view of Law as something separated from politics and from the fight for power. After that, its made a description of some facts that demonstrate this very close relation, with especial attention to the judicial activism. Finally, it is looked to demonstrate that the Law is an instrument of political actions, independent of the pretension of neutrality or the ideological specter that is chosen, claiming the members of the legal profession to recognize this hole. |
