| Abstract: | O presente estudo visa a compreender a contribuição do modelo de interpretação judicial principiológica para a efetivação dos direitos sociais na atualidade. Esse novo modelo permite tanto a construção do juiz no plano da aplicação do direito quanto a participação da sociedade na concretização daqueles direitos decorrentes de normas que, por sua natureza, possuem baixa densidade normativa. Essa Nova Hermenêutica Constitucional caracteriza-se, sobretudo, pela supremacia da Constituição e pela normatividade dos princípios, e desenvolve-se a partir das contribuições da Hermenêutica Filosófica. |
| Abstract: | This dissertation aims to understand the contribution of the principle-based model of judicial interpretation towards the effective implementation of social rights in contemporary society. This new model allows for a proactive role of both the judge and the society in promoting those rights stemming from norms with a low-density normative content. This New Constitutional Hermeneutics is characterized essentially by the supremacy of the Constitution and the normativity of principles, also developing from the contribution of the Philosophic Hermeneutics. |
