| Abstract: | A violência deixou de ser preocupação apenas do Estado e estendeu-se a todos os cidadãos. Os índices estatísticos1 da Fundação João Pinheiro2 incluídos nesta pesquisa indicam que uma das maiores preocupações do ser humano hoje é exatamente o aumento da criminalidade. Esse aumento tem várias causas e, entre elas, o desemprego e as drogas, fazendo com que a Polícia passe a ter maior responsabilidade, principalmente quando na efetuação de abordagens, em especial quando essas ocorrem em veículos que poderão estar ocupados por suspeitos ou não e, dependendo da situação, do tipo de abordagem, ela pode configurar violação aos Direitos Humanos. Para este estudo os procedimentos metodológicos que foram utilizados foram a pesquisa bibliográfica; a pesquisa de campo por meio de um questionário; a pesquisa de campo por meio de observação encoberta3 e a forma de abordagem do problema foi a pesquisa qualitativa. Os Direitos Humanos são títulos legais que toda pessoa tem como ser humano, são universais e pertencem a todos. Não se pode definir a origem dos Direitos Humanos, vez que, em sua acepção essencial nascem com a origem do próprio ser humano. O Manual de Prática Policial inicia relatando que a abordagem é uma atividade difícil e perigosa e alerta que a falta de padronização tem causado sérias dificuldades no dia a dia dos policiais. Para a realização da pesquisa foi aplicado um questionário em membros de duas Companhias Tático Móvel da Polícia Militar de Minas Gerais. O método utilizado foi a amostragem com o intuito de verificar esta prática policial. Foi procurado demonstrar a relação existente entre os índices estatísticos de criminalidade e a quantidade de operações realizadas pela Polícia Militar. Se o número de crimes aumenta em determinada categoria é necessário um trabalho mais direito da Polícia Militar para coibir esta categoria de crime. A pesquisa respondeu ao problema proposto que foi verificar se a abordagem policial militar realizada em veículos automotores, pelas Companhias Tático Móveis, garante aos abordados os seus Direitos Humanos. Dos entrevistados, a maioria considera que, de alguma forma, o tipo de abordagem proposta pelo Manual de Prática Policial da Polícia Militar do Estado de Minas Gerais, baseado no Manual do Comitê Internacional da Cruz Vermelha, não foi garantista dos Direitos Humanos. |
| Abstract: | Violence is no longer concern only the state and has spread to all citizens. The statistical4 João Pinheiro5 Foundation included in this study indicate that a major concern of human beings today is exactly the increase in crime. This increase has many causes, and among them, unemployment and drugs, making the Police now has greater responsibility, especially when in the effectuation of approaches, especially when these occur in vehicles that may be occupied by suspects or not and depending on the situation, the type of approach, it can set up human rights violations. For this study, the methodological procedures that were used in this bibliographic research, the field survey through a questionnaire, field research through observation and covert6 way of approaching the problem was the qualitative research. Human rights are legal titles that everyone has as a human being, are universal and belong to everyone. You can not define the origin of Human Rights, since, in its essential meaning born with the origin of human being. The Manual of Police Practice begins reporting that the approach is a difficult and dangerous activity and warns that a lack of standardization has caused serious difficulties in the daily lives of police officers. To conduct the study was a questionnaire to members of two companies Tactical Mobile Military Police of Minas Gerais. The sampling method was used in order to verify this police practice. He was trying to demonstrate the relationship between the statistical indices of crime and number of operations carried out by military police. If the number of crimes increases in a given category is more work needed right from the Military Police to curb this crime category. The survey said that the proposed problem was to determine whether the approach carried out in military police vehicles, the Tactical Mobile Companies, addressed to guarantee their human rights. Of the respondents, the majority believes that, somehow, the approach proposed by the Police Manual of Practice of the Military Police of Minas Gerais, based on the Manual of the International Committee of the Red Cross was not guaranties Human Rights. |
