| Abstract: | O presente trabalho pretende identificar o regime jurídico aplicado à previdência privada fechada, verificar se ele está em consonância com o objetivo de garantir o benefício contratado, nos termos do art. 202 da Constituição da República Federativa do Brasil e diagnosticar aqueles caracteres que representam risco a esse objetivo e, por conseguinte, ao princípio da proteção da confiança. A pesquisa tem caráter interdisciplinar, com investigações no campo do direito, a partir de uma vertente jurídico-dogmática. Toma por marco teórico a teoria dos sistemas e o princípio da proteção da confiança, interpretada segundo a doutrina de Claus-Wilhelm Canaris. Pretende-se concluí-la com abrangência geral, extensível a todas as partes componentes do sistema. A presente dissertação é resultado de pesquisa desenvolvida junto ao Programa de Pós-Graduação da Faculdade de Direito da Universidade Federal de Minas Gerais, como condição para obtenção do título de mestre em Direito. |
| Abstract: | The present work aims to study the legal regime of closed private pension funds and verify if it was built accordingly to the objective of securing the pension to the beneficiaries, pursuant to article 202 of the Constitution of the Federative Republic of Brazil, signalizing what could represent a risk to that objective and, therefore, to the principle of protection of trust. The research has a multidisciplinary approach, with investigations in the field of Law, following the legal-dogmatic aspects of the issue. Takes as theoretical framework the studies developed for Claus-Wilhelm Canaris about the systems theory applicable to the Law and the principle of protection of trust. The conclusions are intended to be comprehensive, applicable to all relevant parts of the system. The present research was developed as a condition to obtain the title of Master of Law for the Federal University of Minas Gerais (Brazil). |
