dc.description.abstract | There is an insuperable correspondence between law and violence that best identified with the exercise of the most genuine prerogative of the sovereign power, the state of emergency declaration. This correspondence between law and violence is analyzed by Walter Benjamin in a famous essay 1920/1921, entitled For a critique of violence, which he said, without giving much explanation, the existence of another violence, one that would not be carrying a linked to the right, but that would be able to depose him. He calls the pure violence (reine Gewalt). This pure violence carry the potential to establish the real state of exception, structure, present in the writings of Walter Benjamin would be able to end the state of emergency made rule. This Benjaminiana perspective, this thesis seeks to analyze, finds support in the tradition of the oppressed and seeks to cause a break in the continuum of history and linear time, and the end of the mythical law. | pt_BR |
dc.description.resumo | Há uma insuperável correspondência entre direito e violência que melhor identificamos com o exercício da mais genuína prerrogativa do poder soberano, a declaração do estado de exceção. Essa correspondência entre direito e violência é analisada por Walter Benjamin em um famoso ensaio de 1920, Para uma crítica da violência (Der Kritik sur Gewalt), onde ele afirma, sem dar muitas explicações, a existência de uma outra violência, uma que não seria portadora de um nexo com o direito, mas que seria capaz de depô-lo. Ele a denomina de violência pura (reine Gewalt). Essa violência pura carregaria a potencialidade de instaurar o real estado de exceção, estrutura que, presente no pensamento de Walter Benjamin, seria capaz de por fim ao estado de exceção feito regra. Essa perspectiva benjaminiana, analisada nesta dissertação, encontra apoio na tradição dxs oprimidxs e busca provocar uma ruptura no continuum da história e do tempo linear, bem como o fim da violência mítico-jurídica do direito. | pt_BR |
