| Abstract: | Nas últimas décadas, a proteção do patrimônio cultural se intensificou tanto no âmbito internacional e regional quanto no âmbito doméstico. Não obstante aos esforços realizados nesse sentido, o tráfico internacional de bens culturais é uma realidade que atinge Estados em todo o mundo, movimentando vultosas quantias todos os anos. A preocupação tem aumentado na medida em que tem se observado a associação do tráfico com outros tipos de crimes, como terrorismo, lavagem de dinheiro, corrupção, outras modalidades de tráfico, além da prática desse crime no âmbito da criminalidade organizada transnacional. Analisando-se o ordenamento jurídico interno brasileiro, constatou-se que ele não está completamente em conformidade com o que é requerido do Estado Brasileiro levando em consideração as principais obrigações contraídas no âmbito internacional no que diz respeito ao combate do tráfico ilícito de bens culturais. Sendo assim, ao final, foram realizadas recomendações a fim de que as normas internas que se referem à questão estejam adequadas a tais obrigações. |
| Abstract: | In the last decades, the protection of the cultural patrimony has intensified in the international, regional and also at domestic level. Notwithstanding the efforts made in this regard, the international traffic in cultural goods is a reality that reaches States around the world, handling huge profits every year. Concern has increased as the association of trafficking with other types of crime, such as terrorism, money laundering, corruption, other forms of trafficking, and the practice of such crime in the context of transnational organized crime has been noted. Analyzing the Brazilian legal system, it was verified that it is not completely in compliance with what is required of the Brazilian State taking into account the main international obligations with regard to combating illicit trafficking in cultural goods. Therefore, in the end, recommendations were made so that the domestic rules that refer to the issue are adequate to such obligations. |
