Abstract: | Este trabalho apresenta uma análise, na perspectiva da Lingüística Textual, do fenômeno da retextualização, focalizando as transformações ocorridas durante a construção do Gênero Depoimento prestado pelo acusado/réu ao Delegado de Polícia/Juiz, tanto em Delegacias de Polícia quanto em Fóruns. As atividades de retextualização analisadas são as que ocorrem durante as audiências oficiais, em que há a passagem do texto oral dialogado, construído pelo operador do Direito e por quem é por ele interrogado, para um segundo texto oral monologado, produzido também oralmente pelo operador do Direito, de forma exclusiva, que o dita on line para o Escrivão e este, por sua vez, o consigna, sem interferências, no denominado Termo de Depoimento (depoimento escrito que instruirá os autos do Inquérito/Processo). Os fenômenos lingüísticos analisados neste estudo, que surgiram durante a transformação da fala para a escrita, evidenciam que o Interrogatório Policial/Judicial constitui um tipo de interação assimétrica, em que o operador do Direito dirige, comanda a fala do outro. Dessa forma, este trabalho pretende demonstrar que o discurso jurídico penal, construído durante o processo de retextualização nas Tomadas de Depoimento do acusado/réu na esfera criminal, por vezes pode vir a servir como instrumento de manipulação na e pela linguagem e, até mesmo, de condenação do acusado/réu. |
Abstract: | This work shows an analysis of a transformation phenomenon of a text into another (re-textualization) from the Textual Linguistics perspective. It focuses on the transformations occurred during the "Testimony genderbuilding testified by various suspects/defendants to Police Officers/Judges, both in Police Stations and Tribunals. The re-textualization activities analyzed are the ones that occur during official audiences, where a dialogical oral text - built by the law professional and the person by him interrogated, is converted into an oral monological text,produced exclusively by the law professional, who dictates it online to the notary who, in turn, consigns it, without interferences, in the "Testimony" (written statement that will instruct the courts Inquiry/Process records). The linguistic phenomena analyzed in this study, which emerged during the transformation of speech into writing, make it clear that the Police/Judicial Inquiry constitutes a kind of "asymmetric interaction", inwhich the law professional directs, commands the other's speech. Thus, this work aims at demonstrating that the criminal judicial speech, built by the transformation phenomenon of an oral into a written text during asuspect/defendant's "Oral Testimony", may sometimes come to serve as a manipulation instrument in and by language, and, even, as a condemnation instrument of the suspect/defendant. |
