Resumo
Esta tese analisa a prática parlamentar de obstrução, especialmente após as modificações introduzidas pela Resolução nº 21/2021, que alterou o Regimento Interno da Câmara dos Deputados. A principal questão investigada é se essas alterações tiveram um impacto significativo na prática obstrutiva, uma ferramenta historicamente usada pela minoria para bloquear ou atrasar a aprovação de proposições. Para alcançar esse objetivo, o trabalho propõe uma análise teórica abrangente da obstrução parlamentar, abordando conceito, surgimento e mecanismos históricos. Além disso, faz-se uma comparação entre os instrumentos de obstrução que estavam em vigor antes e depois da referida Resolução, incluindo avaliação de proposições legislativas nos dois anos anteriores e nos dois anos posteriores à promulgação da Resolução. A abordagem é baseada em levantamento bibliográfico e análise de dados disponíveis em plataformas eletrônicas, como o site da Câmara dos Deputados. Registram-se também questões pertinentes sobre o papel da obstrução parlamentar no contexto legislativo atual, em que se pretende contribuir para o debate sobre se, apesar das reformas regimentais, a obstrução ainda permanece relevante e funcional.
Abstract
This thesis analyzes the parliamentary practice of obstruction, especially after the modifications introduced by Resolution No. 21/2021, which amended the Internal Regulations of the Chamber of Deputies. The main question investigated is whether these changes had a significant impact on the obstructive practice, a tool historically used by the minority to block or delay the approval of proposals. To achieve this objective, the work proposes a comprehensive theoretical analysis of parliamentary obstruction, addressing its concept, emergence, and historical mechanisms. In addition, a comparison is made between the obstruction instruments that were in force before and after the aforementioned Resolution, including an assessment of legislative proposals in the two years before and in the two years after the enactment of the Resolution. The approach is based on a bibliographic survey and analysis of data available on electronic platforms, such as the website of the Chamber of Deputies. Pertinent questions about the role of parliamentary obstruction in the current legislative context are also raised, in which the aim is to contribute to the debate on whether, despite the procedural reforms, obstruction still remains relevant and functional.
