Obstrução parlamentar: instrumentos regimentais obstrutivos: análise no contexto da Resolução nº 21/2021 da Câmara dos Deputados

Abstract

This thesis analyzes the parliamentary practice of obstruction, especially after the modifications introduced by Resolution No. 21/2021, which amended the Internal Regulations of the Chamber of Deputies. The main question investigated is whether these changes had a significant impact on the obstructive practice, a tool historically used by the minority to block or delay the approval of proposals. To achieve this objective, the work proposes a comprehensive theoretical analysis of parliamentary obstruction, addressing its concept, emergence, and historical mechanisms. In addition, a comparison is made between the obstruction instruments that were in force before and after the aforementioned Resolution, including an assessment of legislative proposals in the two years before and in the two years after the enactment of the Resolution. The approach is based on a bibliographic survey and analysis of data available on electronic platforms, such as the website of the Chamber of Deputies. Pertinent questions about the role of parliamentary obstruction in the current legislative context are also raised, in which the aim is to contribute to the debate on whether, despite the procedural reforms, obstruction still remains relevant and functional.
