Contratos inteligentes na Blockchain: validade e restrições

Abstract

This paper investigates one of the applications available in blockchain, a platform of technology base, which allows self-executing smart contracts, among other applications. The reading of its characteristics shows that the smart contract in the blockchain is a legal algorithm that enables unprecedented contractual efficiency, through the uninterrupted and irreversible contractual adjustments programmed. Although there are already studies that intend to make the content of these contracts more flexible, this modality breaks with the paradigms of the contractual theory on which essentially analogical legal relations are based. Thus, from a hypothetical-deductive method, we intend to outline the contours of what would be an intelligent contract, its scope of application and point out some possible restrictions.
