Resumo
O objetivo do artigo é discutir o desenho federativo brasileiro na organização da Educação, examinando as instituições federativas no que se refere à repartição de competências entre elas, em matéria educativa. Será examinada a ADI 2501-5, cuja problemática é o conflito de interesses entre a União e o Estado de Minas Gerais, por meio da controversa atuação do CEE-MG em relação ao Ensino Superior privado no âmbito do Estado. A análise da ADI tensiona o binômio centralização/descentralização de poder entre os entes federados, em matéria educativa.
Abstract
The aim of the article is to discuss the Brazilian federal design in the organization of Education, examining the federative institutions regarding the distribution of competences between them, in educational matters. The study examines ADI 2501-5, whose problematic is the conflict of interests between the Union and the State of Minas Gerais through the controversial action of the CEE-MG in relation to the private institutions of Higher Education in the scope of the State. The analysis of the ADI stresses the binomial centralization / decentralization of power between the federated entities, in educational matters.
