Resumo
O presente trabalho analisa a crise da legalidade sobre os aspectos da falência da legitimidade do Estado e da crise do Estado de Direito. Os poderes estabelecidos carecem de representatividade junto à população, que não credita mais à lei um meio de expressão da justiça. A hipótese averiguada demonstra que os pressupostos e técnicas da Legística possuem meios para o restabelecimento da credibilidade da lei no processo legislativo. Utilizou-se o método jurídico-dedutivo na pesquisa bibliográfica, com marco teórico na teoria do Estado de Direito, de Jacques Chevallier e na Legística, que visa impulsionar a produção eficiente e eficaz da norma jurídica.
Abstract
The present paper analyze the legality crisis on the aspects of the bankruptcy of the legitimacy of the State and the crisis of the Rule of Law. The established state branches lack popular representativeness, which no longer accredits the Law a means of expressing justice. The hypothesis tested demonstrates that the assumptions and techniques of the Legistic have the means to reestablish the credibility of the law in the legislative process. The legal-deductive method will be used in bibliographical research, with a theoretical framework in Jacques Chevallier’s theory of the rule of law and in Legistics, that improve the efficient and effective production of the legal norms.
