A Linguagem Simples na atividade jurisdicional do Tribunal de Justiça de São Paulo: adoção e aplicação do Pacto Nacional do Judiciário pela Linguagem Simples do CNJ

Abstract

In 2024, the Court of Justice of the State of São Paulo joined the National Pact of the Judiciary for Plain Language, established by the National Council of Justice (CNJ). Based on an empirical and interdisciplinary approach, this paper aims to analyze the institutional practices implemented and to assess whether judges have effectively adhered to the proposed guidelines, with special attention to the language used in the drafting of judicial decisions. The importance of clear language in promoting citizenship and access to justice is discussed, followed by an examination of CNJ Recommendation No. 144/2023 and the principles of the Pact itself. The empirical stage of the study involves mapping the measures adopted by the aforementioned court and conducting a qualitative analysis of judicial decisions issued after the adoption of the commitment, in order to evaluate the effectiveness of plain language implementation in the judicial context. The research highlights the relevance of the initiative while also pointing out the concrete challenges to its full implementation within the Brazilian judiciary.
