Resumo
O presente artigo aborda os contratos firmados para implantação da logística reversa de embalagens plásticas de óleos lubrificantes pós-consumo no âmbito estadual. O objetivo da pesquisa é comparar todos esses contratos firmados nos estados do Brasil, desde a publicação da Política Nacional de Resíduos Sólidos até dezembro de 2015, analisando possíveis semelhanças e divergências entre eles. Como abordagem metodológica, utilizou-se a pesquisa bibliográfica e a pesquisa documental. Os documentos analisados foram as legislações ambientais vigentes, em especial a Lei N.º 12.305; e os contratos visando à logística reversa de embalagens plásticas de óleo lubrificante pós-consumo (Termos de Compromissos). Os resultados deste estudo indicam que a falta de padronização nos respectivos contratos pode levar a diferentes entendimentos sobre a logística reversa. Além disso, evidenciou-se a existência de diferentes níveis de amadurecimento e estágios de implementação da logística reversa no país, que são potencializadas pela inexistência de informações sobre tais contratos no Sistema Nacional de Informações de Resíduos Sólidos (SINIR).
Abstract
his article deals with the contracts signed for the implementation of
reverse logistics of plastic packaging of post-consumer lubricating
oils at the state level. The objective of this research is to compare all
of these contracts signed by Brazil states since the publication of the
Solid Waste National Police until December 2015, it analyzes possible
similarities and differences among them. For a methodological
approach, bibliographic and documentary researches were used.
The documents analyzed here are the current environmental
legislation, in particular Law No. 12,305; and contracts on reverse logistics of post-consumer lubricating oil plastic containers (Terms of Commitment). The results of this study indicate that the lack of standardization in the respective contracts can lead to different understandings about reverse logistics. In addition, the existence of different levels of maturation and stages of implementation of reverse logistics in the country evidences lack of information on such contracts in the National Information System for Solid Waste (SINIR).
