Regulação e controle dos serviços públicos de saneamento básico: agências reguladoras e controle social à luz da Lei n. 11.445/2007

Abstract

This paper aims to analyze and comprehend the regulation and control of water and sewerage public services respectively performed by regulatory agencies and the civil society. In order to do so, this paper introduces legal concepts and rules about the regulation of water and sewerage public services with emphasis on the competence and means of providing the organization, regulation and controlling functions of these services. This paper also introduces alternative solutions to enforce the social control of the water and sanitation public services performed by the competent bodies and agencies. After analyzing the subject, it was found that the regulation and control of public services are topics which have received little attention despite their relevance. Therefore, this paper attempts to introduce specific issues, very little considered, but quite relevant, not just because of the social impact of these services, but also because of the period of ten years after the enactment of the Federal Law n.11.445/07 in which few has been said about certain aspects of water and sewerage public services in the academic environment.
