Resumo
Intentamos compreender os meandros da relação Estado-sociedade analisando os pormenores da individualidade e suas insuficiências, buscandos acolhida nas áreas da Filosofia Política, Filosofia e Teoria do Direito, Teoria do Estado, Teoria da Justiça e História do Estado de Direito e Tais relações podem estar direta ou indiretamente ligadas ao funcionamento do Estado de Direito, pela via da cidadania (participação política); pelos tortuosos caminhos do judiciário (onde algumas vezes têm-se a ilusão de que é onde se encontrará a Justiça); ou através da não relação, daqueles que muitas vezes se encontram à margem de qualquer resquício de cidadania ou reconhecimento de si-mesmo. Assim sendo, com objetivo de estabelecer condições teórico-filosóficas consolidadas para a tese, teremos como arcabouço a filosofia hegeliana, tanto no que diz respeito ao Estado, assim como também no que tange a questão da sociedade civil e do indivíduo e sua subjetividade.
Abstract
We seek to understand the intricacies of the state-society relationship by analyzing the details of individuality and its shortcomings, looking for support in the fields of Political Philosophy, Philosophy and Theory of Law, Theory of the State, Theory of Justice, and the History of the Rule of Law. Such relationships may be directly or indirectly linked to the functioning of the Rule of Law, through the avenue of citizenship (political participation); through the tortuous paths of the judiciary (where sometimes there is the illusion that Justice can be found); or through the lack of relationship, of those who often find themselves on the margins of any semblance of citizenship or self-recognition. Thus, with the aim of establishing consolidated theoretical and philosophical conditions for the thesis, we will use Hegelian philosophy as our framework, both in relation to the State and concerning the issues of civil society and the individual and their subjectivity.
