Resumo
O estudo apresentado pretende contribuir e dialogar com a literatura do direito no que se refere aos estudos da transição brasileira, analisando a configuração institucional do Supremo Tribunal Federal (STF) durante a Ditadura Militar e o desenho institucional instituído pelos governos militares; demonstrando a relação existente entre o STF e o regime militar durante a transição; analisando a participação dos Ministros do STF durante a Assembleia Nacional Constituinte de 1987; e avaliando os resultados encontrados na parte documental da pesquisa em face da Justiça de Transição e da Teoria da Reconstrução Constitucional.
Abstract
The study presented in this dissertation aims to contribute to and dialogue with the Law literature regarding studies about the Brazilian transition, analyzing the institutional configuration of the Federal Court of Justice (STF in its Portugues acronym) during the Military Dictatorship and the changes in its institutional design implemented by the military governments, demonstrating the relationship between the Court and the Military Regime during the transition. It also analyzes the participation of the Ministers during the National Constituent Assembly of 1987, evaluating the results found in the documentary part of the research in the face of Transitional Justice and Constitutional Reconstruction Theory.
